Buyers default want escrow check back!What would you do?
In three days we were supposed to go to a closing, only one obstacle remains. The buyers just called to inform me that they won`t close, they have decided to change their minds.
We spoke for 45 minutes and i attempted to explain to them what will transpire to no avail! Unfortunately the buyers refuse to believe their escrow check is non-refundable! They called to ask me what time they can stop by tomorrow to pick up the check!
It appears an executed contract is meaningless. They refuse to hear the truth!
The conversation is as follows:
Default Buyers: My wife and i changed our minds. We don`t want the town home now!
Me; We`re supposed to close in 3 days. What do you want me to do?
Default Buyers: Call the owner and tell them we`re sorry. We changed our minds..
Me: That`s great, but we have a contract, if you default, you lose! It`s that simple.
Default Buyers" Lose? Lose what our money? Hell No!!!
Me: It`s not that simple, you`re sure you really want to walk away?
Default Buyers: What time can we stop by tomorrow to pick up our check?
I`m sure this has happened to others out there. The buyers are under the impression, that it`s that simple, "No Harm, No Foul"... I pray that reality sets in between now and tomorrow!

Fair is Fair! Landlord wants us to pay $100 cleaning fee for former tenant!
We received a call from a former client who we rented a home for them 12 months ago.They live out of the area.The tenant that we located,moved out yesterday.
The landlord found a new tenant on their own and it appears they`re moving in next week.
The landlord called us yesterday to find out if we can send someone over to the home to clean the home.
We use a cleaning service that charges $100. They do fantastic work.
I recommend to the landlord that he contact them to arrange for their service.He seemed OK with it until i mentioned the $100 fee.

The conversation is as follows:
Landlord: How come I have to pay the $100 fee, shouldn't it be coming out of you`re end, after all you rented the home for us, the tenant moved out, why aren`t you and you`re company paying the fee?
Me: I`m sorry, we rented the home for you 12 months ago, the former tenant moved,you located a tenant on your own. How is it my responsibility to send a cleaning service to your home?
Landlord: It`s a service I thought a Real Estate office should perform, besides it`s good business practice on you`re part! Next time, I`ll give you the house to rent again, how`s that?!
Me: Good business practice? If I follow you`re advice I`d be out of business. The former tenant paid the rent, the lease expired, you found a new tenant and I have to pay for the home to be cleaned?
Landlord:Yes, I think that`s fair.
I`m deadpan serious, his response "Fair is fair" floored me! It`s his home,his tenant and we`re supposed to compensate the landlord a $100.00 fee for a tenant we located for them a year ago!
Why me?

Today in the Ocala Star Banner. A classic example of media hype!
Today in the Ocala Star Banner there is a very interesting article for all Marion County Realtors to enjoy or cry about!
It`s entitled:HOME SALES DOWN 50 PERCENT FROM 2006 (http://ocala.com/article/20070707/NEWS/207070343/1025/NEWS)
I`m never one to get involved in the media hype because i believe the media has a right to print the news as they see fit! After all that`s the "Newspaper game" I do take offense though to the huge void left in this article written by Mabel Perez.
Here is my rebuttal:
The state of Florida as a whole has seen th market go from bad to worse. There`s no denying what`s happening in Real Estate. Marion County overall never really felt how bad the rest of the state has seen,and probably never will. Sure, it`s not a great market, but the opportunity is there.
Part of the biggest problem in Marion County currently is that many sellers haven`t come to "terms" in regards to properly listing their homes.
Many Realtors in the area have actually fueled this problem and made it an obstacle. I can`t tell you how many time agents inside of our company have placed "Offers" to sellers around Marion County,only to be told by the selling Agent "Our client won`t consider this offer".Some refuse to present offers or even counter, it`s not like the old days, you have to work for the sale. Not all Realtors in Marion County are like that!
The Ocala market is far from collapsing. The fact is now is the time to be a buyer! I have no idea why the reporter failed to mention this, or the Realtors who were interviewed. The rental market in Ocala seems to be thriving, which will lead to potential buyers down the road. Many buyers were caught off guard with sub prime lenders and are now seeking alternatives such as FHA loans.
Again, Ocala isn`t as bad as the article portrays and I wish that when doing a story like this, all the facts are presented, not just the Media Hype!

Are "Low Ball Offers" really working?
Our listing in Coral-Springs is priced to sell.
The home as you can see is beautiful and the sellers made sure to price it in the realm of reality.
The home is listed for $589K, an offer arrived yesterday which floored both the sellers! I always preach not to get emotional when negotiating a sale.
The offer came in at $429K, which borders on the sublime. I expressed to our sellers, that irregardless of the buyers offer, they need to counter to see if there is any seriousness in the buyers approach to purchasing a home!
Now more than ever in a buyers market,people sometimes get a little ridiculous and lose focus at the "value" of a home. A home that is priced to sell, doesn`t mean priced to steal, or as i mentioned I had hoped not! We just sent over a counter to the buyers agent who seems reasonable and is questioning her buyers logic as well.
I hope to have a response, although am wondering what the buyers are thinking by using a "Low Ball Offer".
In June I wrote another article entitled " Is your listing priced to sell or priced from H^ll?".
I described how some sellers have "delusion's of grandeur in thinking they`re home is worth more than the market bears." It`s always fun to go back to what you wrote! Maybe the market has shifted and the buyers are having delusions, I see that happening more often.
The sellers and I discussed that in this instance, it`s not worth getting emotional. Hopefully, we`ll see shortly if this buyer is serious or just "throwing out numbers".

How many understand the Section 8 Guidelines for Rentals?
I have a question that needs to be addressed to many Realtors out there who are risking their Real Estate license in order to complete a Section 8 rental.
Section 8 housing is geared to assist those who aren`t able to pay rent.
There are Programs & Guidelines that we must adhere too.
That being mentioned why are some of you attempting to participate in Bribery?
Recently, I received a call from a Realtor who didn`t have a clue how the system works. They called me to ask if our landlord would accept Section 8 housing vocuhers plus an additional $350 per month from the tenant.
I explained that the voucher for a 3bed,2ba home is $1350 which is what the landlord receives,it`s very illegal for the landlord to take any additional monies and besides that the person on Section 8 who is actually doing something like that would be automatically thrown off the program.
Why do some people on Section believe this is some sort of "Reward" or "Gift". Better yet, if you`re a Realtor who doesn`t understand the Allowances that Section 8 clearly states isn`t about time you familiarize yourself with the rules?
One more thing, please don`t call us, attempting to negotiate in illegal activity...It`s a waste of time.

I'm not criticizing Redfin at all for having this type of business model, what I don't get and this is where we're confused is how do the agents at Redfin get other agents to "Open Doors" for their clients? Broward County 1st Time Home Buyers Seminar!

Yesterday afternoon, we held our first of 3 series "First Time Home Buyers Seminar" in Cooper City, Florida. There were 24 first time home buyers who attended our seminar. Most of the questions revolved around concerns in mortgage payments,taxes and the affordability of buying a home.
The main objective of our seminar was to teach these new buyers what to look for in buying a home.
A sort of step-by-step process to home buying. Many hadn`t realized that without the proper credit scores, they wouldn`t be able to buy a home. Others were interested in learning about Grant programs and FHA loans. What we were able to accomplish yesterday was to assist 10 people towards "Buying a Home".
One couple in particular immediately wanted to start searching for a new home, once they realized the type of program that are out there for buyers.
It`s a wonderful feeling to see so many eager new 1st time home buyers looking to purchase a home.
The majority of new buyers range from 21-35. Many are looking at buying town homes and condo`s for their first homes,realizing it`s easier to maintain. What I truly enjoyed was the buzz we felt from each person who came to our seminar. The feeling or rush we had was amazing!

I must admit, we`re threading in waters that we`ve never seen in Real Estate. I have yet to conduct a transaction this year without some form of creative financing. Forget Closing Costs, we`re actively involved in conducting transactions on $400K homes with 0 ( zilch, Nada,nunca) Down!

It`s hard to believe that we`re actually considering these deals,but with the market in complete chaos, my attitude is to make these transactions work!
Two years ago, if these offers came across our desk I would have contacted the seller, explained the situation and would have told him, it might be better to wait out a better offer!
Now, I`m involved in telling the sellers, that we can "Make it Happen"..... It`s 10x`s harder to get done, more addendum's, more playing it close to the vest,but, it`s working.
I`ve completed 7 Lease-To-Own Transactions so far, that`s 3 more than we completed in 2006!
My attitude is simple: As Professionals we`re taught to work with what the market offers, not fight it!
The term "Lead,Follow, or Get out of the Way". is our new motto for 2007! I have never seen a market like this, nor will I probably ever again. When the smoke does clear " Many will be tested and retested, why they chose this profession". I know after 10 years, I have!
At this point a person involved in the dealing of Real Estate each day must be "Better Prepared" than ever before!

Broward County's beleaguered housing market showed slight improvement at the end of 2006, giving some hope that the worst of the yearlong slump might be over.The median price of an existing home last month was $367,600, only a slight drop from the $369,000 in December 2005, the Florida Association of Realtors said Thursday. There were 618 sales, a 7 percent drop from 666 in December 2005.While certainly not stellar, those figures are better than what many people had expected after sales remained slow throughout the year and prices started dropping in the summer and continued through the fall.

West Palm Beach housing analyst Brad Hunter said he sees a glimmer of hope for frustrated sellers."We're not out of the woods yet," he said. "But we're starting to see some signs of a return to equilibrium very slowly."Mike Larson, an analyst with Weiss Research in Jupiter, isn't as optimistic.

Interest rates are creeping up, and he expects the inventory of homes to rise as frustrated sellers who took their properties off the market late last year try again this spring."Sellers shouldn't expect sunshine and roses in 2007," Larson said. "If you're a buyer, I expect you'll be in the driver's seat, and you should negotiate like it."Analysts agree that it will take months to sell all the properties on the market. Broward now has 35,362 homes and condominiums for sale, more than double the number from this time last year, according to Keyes Co. Realtors.For 2006, the median price for an existing home in Broward was $367,800, up 2 percent or $6,700 from 2005's $361,100. The median means half the homes sold for more, half for less.Sales fell 26 percent last year, putting the county in the middle of the pack with other metropolitan areas statewide.

The condo market remained uncertain as sales for the year declined sharply but prices rose.After a five-year boom, Broward's housing market faded last year, as short-term investors left the market. Sellers who were accustomed to multiple full-price offers and fast deals waited weeks or months just for someone to look at their homes.Sellers resorted to offering cars, cruises, bonuses and other perks to buyers and their agents, often to no avail.

Some desperate sellers held auctions, while others inquired about swapping homes.Sherrie Nemetz of Plantation has been trying to sell her four-bedroom home for nearly a year. She finally fielded her first offer, and it was for more than $100,000 less than the $449,900 listing price.She has reduced the price and switched agents. Her next goal: trying to improve how the house shows on the Internet."There are just so many houses on the market," Nemetz said. "If your house isn't marketed correctly, there's no incentive for people to look at it."

But Mike Pappas, president of Keyes, said he expects sales to pick up as buyers try to beat looming interest-rate hikes.What's more, Florida legislators decided to pass a measure that's expected to lower Floridians' property insurance costs. Gov. Charlie Crist signed the bill Thursday."That definitely brings some stability and a calmness to the market," Pappas said.As the market sagged in 2006, foreclosures became a major concern.

Credit scores range from 350 (poor) to 850 (excellent).
Here are six steps to raise your FICO score:
Pay bills on time! Your payment history makes up 35% of your FICO score.
Don't consolidate and then close out your old, revolving debt accounts. The age of your credit accounts is an important, positive factor for a good credit score.

Young Couple resurface after three weeks to purchase home. It sold!

Steve Brown is one of our new agents in Ocala,Florida. His efforts have really paid off for him. Steve has been in the business for only 8 months and he`s gained so much insight towards the business of dealing with the trials and tribulations of this crazy profession!
Steve had been dealing with a young couple that placed an offer on a home. The home is a 3bed,2BA,2CG SF with 1/2acre of land. The couple kept going back and forth with Steve for weeks. Steve made sure that the buyers had closing costs,repairs and terms that were very attractive to this couple. One Problem! They failed to execute and vanished from the face of the earth! In this profession, it`s part of business, no matter what you do, sometimes, the buyer isn`t quite ready.

Several weeks go by, Steve continues to attempt to locate this couple to no avail.
In the meantime, we have had other potential buyers see the listing as well. I receive a call from a potential buyer who has extreme interest in this home! He`s willing to drop everything and visit the listing. I gave the lead to another agent in our office who immediately took the buyer to the property. As luck would happen, the young couple out of nowhere contact Steve and are ready to move forward.They want Steve to present their offer. The dilemma begins.
Steve`s young couple`s offer isn`t as strong as the other persons. It was several weeks ago, when we first dealt with this couple, but now with another buyers offer, they`re second.
Needless to say, the owner is presented with both offers, feels bad for the couple,but had to do what`s right for him and his family! The couple, has a hard time understand what transpired,they forgot that they`re not the only people looking to buy a home that`s priced right and the old adage "YOU SNOOZE YOU LOSE" went into effect.
Regardless, if the market is slow or fast a "Homes that are Priced to Sell, will always Sell" no matter what!

What Makes a Good Listing Presentation?

In our markets South Florida and Ocala I have been listing and selling homes for 10 years. When I first started out in Davie Florida Ivanhoe area there were 7,000 people and only three local Real Estate Companies.
I didn’t consider myself a good Realtor back then since I worked out of my house and was with a team.
Over the years I have been able to establish myself as the top listing agent in the community. I`m one of the Top Listing Agents in South Florida,with one of the highest number of sold listings (single family homes) in the last 4 years.
During the last 4 to 5 years South Florida has exploded to over 165,000 people and still growing. There are now hundreds of Realtors from all over South Florida and Ocala Florida who list and sell houses.

As of this morning there are 1,434 houses on the market in the MLS. Looking at these listings Florida List For Less Realty Inc. is in the top 15% of all Real Estate Companies.
I have found that one of the reasons for my success is a rock solid knowledge of the market in our area and a very strong listing presentation.

What makes for a strong listing presentation? Well what I have learned is the best presentation is when the Sellers are doing all the talking. Ask the right questions, sit back and listen. Sellers don’t care about Power Point Presentations, 25 Marketing Strategies for a Successful Sale, Broker Open’s, how many designations you have, how large your company is or a myriad of other things we say to potential Sellers to show how good we are. Remember it’s all about them not about us. The Sellers I meet with on a whole want to talk. They want to show you their house and tell you their reasons for selling. They want to blow off steam from the bad experiences they have had with past Realtors. They want someone that will listen to them and respond accordingly. No scripts, no ABC sales techniques and no print out of all your awards.
What they want is an honest and forthright opinion of what their house is worth and what it will take to sell it. And most importantly they must know that you genuinely care about them and their needs. And believe me this can not be faked. It most be a sincere caring. Bottom line people want to work with people they like and trust. So next time make your listing presentation a listening presentation.

There are plenty of things that I`ve witnessed during my 10 years of selling Real Estate. This one makes the charts with a bullet.
I received a call early this morning from a Buyer who wanted to view our listing in Sunrise, Florida.We agreed to met at the home and here`s where the fun begins.
The guy shows up with his girlfriend, we greet each other and I make sure to hand him our info sheet on the property. All is well, the couple seems happy and we walk in.
I like to always start walking the buyer towards the back of a home for Full effect.The buyers walk outside to view the backyard and the pool. When they re-enter the girlfriend takes out a cigarette and lights up.
Me: I`m sorry the Seller`s are non smokers. Could you put the cigarette out?
Cig Smoker: Are you for real? I`m not doing anything wrong!
Me: This isn`t my house, I`m only the agent, would you please stop?
Cig Smoker: Look Man! We`re looking at buying this home, I want to chill before I look at the rest of the house, not be told what to do!
Me: OK, do as you please but can you step outside and smoke.
At this point the boyfriend chimes in! He`s a burly kind of a guy about 6~2 and 290 pounds.
Boyfriend: Dude, that`s my girlfriend, leave her alone or I`ll take issues with you!
Me; Folks, it`s been nice. Time for the two of you to leave or I`ll call the police.
Girlfriend: You`re some kind of &%$OW aren`t you?
Me: I`m alot of things, but one thing I can`t allow is for you to smoke in a house that isn`t yours!
Call me crazy, call me lazy, but get out! With that they leave mumbling and cursing me as they walk out. When i get back to the office I tell two other agents in the office what transpired. One tells me that they wouldn`t have said a thing about the smoking the other tells me, I was correct.
Now as I`m writing this post, I`m wondering if I right! What a day!

Pembroke Pines Florida Real Estate. Housing market trends.

The National Association of Realtors reported that sales of existing homes edged up 0.6 percent in November to a seasonally adjusted annual rate of 6.28 million units, after a 0.5 percent rise in sales in October.
It marked the first back-to-back increases in sales of existing homes since the spring of 2005 and followed news Wednesday that sales of new homes rose 3.4 percent last month.
The better-than-expected showing for both new and existing home sales could be signaling that this year's severe slide in housing is starting to bottomed out.Again, this is only our professional obeservation,yet, based on other members opinions, the trend may wind up true!
There is caution out there about the rebound. Which is to be expected. Many believe that prices may keep dropping and for several more months sellers will be forced to trim their asking prices more in the face of near-record levels of unsold homes.
For October, the median price for an existing home fell for a record fourth consecutive month, dropping to $218,000, down 3.1 percent from a year ago.
One thing is clear.

The bottom or the Bubble Effect is rebounding and the trend for 2007 does appear to look much better.

NEW YORK POPULATION GOES SOUTH

December 22, 2006 -- New York was one of four states to lose population this year - and may soon be overtaken by fast-growing Florida, U.S. Census Bureau figures show.
The Empire State's 19.3 million people trail only California's 36.5 million and Texas' 23.5 million. But Florida added 321,697 in the year ending July 1 and has 18.1 million, data released yesterday show.
New York lost 9,538 people. If the trend continues, it will fall to fourth place by the end of the decade.
The exodus is partly attributable to immigrants' entering the country through New York City, then moving to areas with lower costs of living.
But Robert Ward of the Business Council of New York State said it could also be attributed to workers' heading for Texas and other states that are gaining jobs at faster rates.
"People are moving elsewhere in search of opportunities they're not finding in New York," he said.
There was other evidence of Sun Belt growth:
* New Jersey was elbowed from the top 10 by North Carolina. The Garden State grew by 21,410 to 8.7 million, North Carolina by 184,046 to 8.9 million.
* Texas gained the most people, 579,275, but Arizona grew the fastest at 3.6 percent - ending Nevada's 19-year run.
* The South grew 1.4 percent, or by 1.5 million, but the biggest loser was post-Katrina Louisiana, dropping about 5 percent, or nearly 220,000 people.

Wall Street paving the way for a Happy Ending. Real Estate Bubble is offically over!

Wall Street helped create the Real Estate Bubble and many of the leading Brokerage Houses on Wall street are now reaping the benefits!
It has always been our opinion that Wall Street lead the way to shift the tides of Real Estate back towards stocks,futures,options,401`s and hedge funds.

They created a panic or buzz that many in our profession realized that "Fear Factor " always creates a panic! Take for example the Christmas Bonus firm Goldman and Sachs. Goldman Sachs Stock Brokers will reap a windfall from the $16 billion in bonuses the firm is set to pay - city and state taxpayers stand to benefit from a whopping $1.6 billion that will be pumped into the public treasury. Estimates of the tax revenues generated by the Goldman gold mine show the state gaining $1.1 billion in revenues and the city reaping a $500 million bonus of its own.

This will have a ripple effect for 2007! In my opinion I look for the Real Estate market to rebound from an abysmal 2006! With those type of bonus,many will look towards new housing as a way to show their new found wealth! This will in turn cause builders,laborers etc to benefit from the additional spending.

This country seems to follow the Boys on Wall Street, as the Street goes, so does the economy or at least the perception that "All is well in the World". With these types of bonuses being thrown around, I look for the market to continue to head higher which in turn does actually create jobs!

Big bonuses have a role in supporting the upper end of the housing market, generating transaction taxes and mortgage taxes,"

I maybe incorrect,but all indications lead me to believe we`ll be heading towards a good 2007!

New Generation of Realtors Part 15: Helping a family that needed a miracle!
On Tuesday evening i received a call from a potential buyer looking to purchase a home. The call came in around 10:00pm. These people sounded desperate and were looking to buy a home. They saw one of our listings on the Internet and wanted to see the home immediately.

The next morning they arrived and explained their situation. They have low credit scores, because they weren`t able to pay off hospital bills! In sad that in this country we still have millions of people who are uninsured! These people are very hard working and are now nurses at the local county hospital in Miami.

They needed a break. I called our mortgage broker who told me, that he`d need at least 3 months to clear up their credit, he assured me,it can be done.

Next, I contacted the seller, who is a 77 year old man, and needs to sell this home, his son,lived there for years and decided he no longer wanted to be in Sunrise,Florida.
The listing was held by another Realtor who wasn`t able to sell it during her 7 month listing agreement.The seller needed a miracle as well. I proposed to the seller that we do a "Lease Option" for six months with an option to purchase the home. I explained to the seller that we can get these people approved in 3-4 months. He agreed.

When it was over, I looked at the buyer and seller and realized what we just had done was a small miracle!

Buyer`s wants Seller to hold $25,000.NO MONEY,NO MONEY,NO MONEY!

We`ve been attempting to put together an offer that frankly we realized was next to impossible to do.In some cases, you pray for a miracle. This wasn`t the case!
Yesterday, was the conclusion to three weeks of hard work. The Buyers agent and Mortgage Broker apparently mislead the buyer into believing that with a 580 credit score,this person would be able to purchase a Townhome in Davie,Florida with 100% financing.

As it turned out the Mortgage Broker later retracted his story and told the buyer that the buyer would have to bring $25,000 to the table. I received a call last night from the Buyer`s agent, we agreed to have the buyer and seller present for one final meeting to see if there were any options left in holding this deal together.

The buyer`s agent was pleasant enough, you could see in the buyers eyes that they were tired of being mislead by the entire process. This was very sad to see, these poor people were being ripped of by their agent!
Buyer`s Agent: I have a wonderful idea, you`re seller holds $25,000 for two years and the buyer will play only the interest of $134.00 a month with a balloon payment at the end!
Me: The buyers income appears to be light! Even if we did agree to hold a second, there is no way conceivable that the buyer will be able to afford to pay the monthly mortgage of $2500 a month, I think you`ve mislead the buyer completely into believing this could happen.
Buyer`s Agent: OH!, they`ll try real hard to pay the mortgage,they're willing to give it a try. The seller walks away from the house and that`s that!
Me: The seller walks away with what though?! He`s left holding the bag, on a hair brain scheme that we both know will blow up in less than 5 months!
Buyer`s Agent: My job is to get these people a house, what happens after that is no concern to me or the bank!!
Me; So screwing your client is OK? Well guess what, it`s no OK for me or our seller!!!

With that I shake the buyers hands and tell them to reconsider signing any papers their agent recommends. It`s hard to imagine that anyone would jeopardize their client, but we got to see it up close and personal..It`s unreal, that people would act like this, especially during the holiday season..

Our seller is having a hard time understanding that an appraisal that was done 7 months ago is no longer valid. They`re not grasping that prices have dropped substantially and a home that was $460K seven months ago is now valued at $433,000.
I keep agreeing with our client in regards to the sales price, but, the fact is an appraisal is still what the Banks will use in order to fund a borrower.
We suggested that either he pulls his home from the market and hope for a bounce in 2007, or take the money and relocate to Atlanta which is where they`re heading.

The offer we originally received was for $442,000, was executed and everything has been going smoothly until now! The fact is there are no recent comps in the last 90 days that can justify the sales price, do to the fact that many other sellers have decided to sell at a lower price. It happens and now the real fun begains for many sellers, who must face reality!

This seems to be a major issue in South Florida and other area`s throughout the state. The market has moved downward and many sellers are still grasping at straws, praying for a miracle! How are many of you handling this situation with your sellers?

The correlation between buyers and gas prices raise a few questions that are geared specifically to our profession. Housing sales slumped when gas was at $80 per barrel. With gas driving itself downwards the question is will buyers come back?
Many times as you`re aware people enjoy driving around and spending an entire day looking at homes, they were limited to do so when the price for Regular was $3.02. Today, the same Regular is $2.25.
I believe that we`ll start experiencing a spike in housing prices and quite frankly a signal that The Bubble Effect is over.As 2007 approaches if gas prices remain at affordable rates, people will see this as a sign that inflation is in check.
Naturally, the media will take several weeks to digest this data,but I assure you that they will come to the same conclusion that you and I are observing.

Three Months ago I did a listing presentation.The home was located in Pembroke Pines. I thought it should have been listed at $429,000.I gave the potential Seller the proper CMA and thought everything went well. Several days later, I called this person, only to find out the listing decided to go FSBO. No big deal. I wished the person Good luck and went on my merry way.
Last night I received a panic call from this person. It went like this.
FSBO. I need your help!
Me; How can I assist you?
FSBO. I signed a contract last night and I didn`t read the entire contract properly.
Me. OH! What did it say?
FSBO. I have to pay 6% to the buyer for closing costs, i don`t want to, that`s almost $13,000.
Me. Why did you sign?
FSBO. I thought I made the right decision, I need out of this, can you tell me what to do?
Me. If you have an executed contract,what do you want me to tell you?
FSBO. I don` want to sell. How do I get out of this?!
Me. If I was in your shoes, i`d call an attorney Monday morning.
FSBO. And spend more money?
This is so typical of certain types of sellers, when the going is good, they know more than the Realtors who do this each and everyday, when the going gets bad, our job is to bail them out without questioning anything and it`s all for free! The moment they have to spend any money, they get ultra insane and it`s our fault. The FSBO last night expected me to get involved, assist her and do this all for Free! Now that she has an executed contract, which was ill advised, she refuses to seek legal counsel. Without any proper representation to our clients our job isn`t to give out free advise, in fact, that`s when people look to take advantage and blame others for their problems. At the end of the call, I wished the FSBO well, and told her, that hiring legal counsel is about the only option left, unless she sells her home with closing costs included..

We made an offer to purchase a beautiful 2bed,2ba Condo in Coral Springs Florida. The listing was for $199,000. The condition of the condo was fair, it needed carpet and a good paint job. The buyer told me to offer " $171,500" based on the closed sales in the area. We called the Sellers Agent, told him the buyer had great credit, 10% down and closing in 3 weeks if the seller required it! The agent did not respond, so I asked "Is anyone still on the line?"
He coughed and proceeded to SCREAM at me! "GET THE HECK OUTTA HERE" he moaned, the listing is for $199,000. Again, I mentioned that comps in the area reflect a sales price closer to $170-$175K, not a penny higher, that the Seller is not realistic isn`t our fault I explained. He again started to SCREAM "MY SELLER WON!T LOOK AT YOUR OFFER! GET LOST", click, goodbye, no have a wonderful day nothing! The buyer who was next time looked pale! She was in a state of shock, and asked me "Are all agents like that?" I told her, we don`t need to deal with him, I`ll call his broker instead.
The Broker as it turns out was not aware of the Agents behavioral patterns boarding on SON OF SAM, he too was a tad perturbed over the incident and told me, he`d handle the offer and make sure he rather than the SON OF SAM would deal directly with the seller. Today, I received a call back from the Broker, guess what! The Seller took our offer in a heart beat, was very grateful to have us close so quickly and offered to clean the carpeting for us! Anyway, SON OF SAM was told to stop acting like a little child and his broker wsan`t thrilled with this boorish behavior. I`m happy I kept my wits and realized that this agent was in Therapy!

In the Good Olde Days The Realtor representing the Buyer did what they were supposed to do in handling their side of the Transaction and the Sellers agent did the same! There were really never any problems and the transaction went smoothly.

Today I`m involved in no less than 3 transactions where am finding my processors and i are doing all the work! In one case we`re dealing directly with the Buyers Mortgage Broker to keep the deal from Dying! The attitude of some of the Realtors are in fact irritating. They don`t return calls,refuse to get involved and overall don`t seem to care if the deal is completed or not! They act like it doesn`t matter to them one way or another. Worse, when I contact their Brokers to explain what`s happening they seem not to care either!
Many times I see on the MLS "Deal Fell Through!" I`m learning first hand why this is transpiring more and more. Where we once assisted each other we now act like we don`t have to do our jobs!

Where we once kept each other informed about the transaction we now "lie,pretend we don`t know and deny everything". This is common, an example is not notifying us that the Buyer changed Title Companies, or Lenders.

It`s rather quite astounding in our business and seems to be the Norm. At first I thought this was only happening in South Florida, but we deal in other parts of the State as well. The same behavior is rampant all over the State! It appears that many of the Old Timers have left the business and many of the new agents have never been trained properly. How else would you be able to explain this new phenomenon?

Seller wants to deal direct with Buyer!

One of our agents has run into a seller who has decided that they`re going to "Play Realtor". On the MLS the listing isn`t "Limited Representation". Our agent took our Buyer into this home on Thursday the buyer seemed interested, it`s priced to sell. On Saturday the Buyer called our Realtor to tell her she`s stopping by the Sellers home because there is an "Open House". The seller immediately recognized the Buyer and told the Buyer that he`s planing on firing his Realtor, and that any further discussions should be done through him! The Buyer is very loyal to our Buyers Agent.She expressed dismay when the Seller told her to "Cut your Agent" out of the deal! I called the Seller and explained that under no circumstance would our Buyer not allow us to represent them in any negotiation. He replied that he won`t pay us any commission! I reminded him, that his listing is on the MLS and he`s offering a commission. He told me he was firing his Realtor and if any Buyer wants to buy his house, "NO REALTORS"...

I`ve made several attempts to call the other Realtor to no avail. The Buyer really wants the house and I sent the offer to the other Realtor, just to make sure I`m proving "Procuring Cause". Tomorrow I call the Board and the Broker for the Sellers agent explain that this Seller is out of control! I`m suggesting that the Brioker contact this Seller and reconfirm that my offer, my client!
Amazing, how some sellers believe that our job is to bring them buyers, only to be cut out of any transaction!

Amazing how happy my client was today when i told them I had somone stop by and mow the lawn. They live out of town, so they`re unable to see high the grass has grown.
I told them i felt that the lawn needed a good cutting in order to show how beautiful their home is.
They agreed and called to "Thank Me" for thinking of them!

We just represented our buyer in a home located in Ocala. The home was purchased for $229,000. The actual appraisal was $234,000. Our buyer requested that we ask the seller for the $5,000 difference to be placed towards closing costs and prepaids.
At first the Sellers agent had no clue what we were asking for,until I explained that the Bank will allow us to collect the difference from the original sale`s price vs appraisal. This would`t effect what the Seller received in any way or hurt the original terms and conditions of the contract except the sales price would change. The Buyer is now extremely happy to offset part of the closing costs. Whenever possible we always try to assist the Buyer in getting back closing costs or at least leave them with an option.

No Means No!

We`re at a closing yesterday in which we represent the Seller. All repairs that were agreed upon were completed weeks ago. Buyers signed off that repairs were satisfactory. At the closing the Buyer wanted us to give them a credit for the carpeting claiming that the Seller left it dirty when moving out. They wanted a credit for $1400. As I explained to both the Buyer and Buyers Agent, the walk through was completed, there were no indications that they wanted the carpet replaced and or cleaned.
The Seller wouldn`t accommodate any longer. "It was Time to Close'
Anyway, we sat there for almost two hours going back and forth until I asked the Seller to "Get up and Leave". I told the buyers that they were now in default and we`d be asking for all escrows. Within 5 minutes of walking out the door, the Buyers agent ran towards us and told us the buyer finally agreed. It`s hard to comprehend what these buyers were thinking, but the old adage "No Means No" was in effect!
We closed and shook hands with all parties as if nothing happened..

Realtors who speak for their clients without permission.

We`re dealing with an agent who feels compelled during our negotiations to continue to tell our Buyer that her Seller won`t agree to our counter-offers and repairs that we`re requesting. Twice now, I`ve explained to her that her job as a Realtor is to pass on the information to the seller, not speak for the seller directly without actually knowing what the Seller may do! I explained to her that she doesn`t really know if the Seller will agree or disagree.

Many times Realtors fail to realize that our very jobs as Realtors is to pass information along to both parties and allow them to decide. Without actually receiving permission from a buyer/seller a Realtor risks jeopardizing the negotiations and could very well lead to an offer being rescinded.In our case it`s very close.

I`ll be contacting this agents Broker today to explain that what this Realtor is doing is both unethical and highly unprofessional and allow the Broker the chance to tell this Realtor what our responsibilities are as professionals.

Several months ago our client told us that she wasn`t satisfied with our service, she felt that we weren`t doing enough to have her home sold. She wanted us to release the listing. I explained that her home was leveraged to the max. on the Internet, the real estate magazines, as well as we did 4 consecutive "Open Houses". It was my opinion that the home was "Overpriced" and antiquated for the price that she wanted. The comps were in the $350,000 range, listing a home at $425,000 would bring no buyers. We held the listing for a total of 60 days. Bought her one offer at $355,000 which she refused.We gave her back the listing and wished her well.

Last night, I received a call from our former client. She wanted me to "Take Back" her listing because the Agent that she hired promised her the world and gave her in her words "Nothing"! She told me that she didn`t realize how much advertising we actually did in comparison, nor could she even get her other agent to do one "Open House". The listings she signed with the other agent is set to expire in two weeks. I assured her that we`d take her listing again, but, this time she allow our company to do what we do, and that`s "Sell Real Estate".

In today`s market, there are too many agents looking to steal other Realtors listings by "bad mouthing, lying, over exaggerating" what they can really do, without much care. In the case of this Seller, she was swayed by a Rookie, who told her "Our Company" won`t sell a home like her national company can. You know the one which guarantees, "They`ll buy You Home"... (SIC)
What most Realtors fail to grasp is that listing a home today, isn`t just about placing it on the MLS and than forget it exists. You have to have the right amount of exposure to ensure that the home is thoroughly represented.
Many Realtors today, fail to believe that. They feel that having a sign is sufficient.
We`re happy that we over extend to our "Buyers and Seller', it`s our belief that the service we provide is at a much higher level than the competition, after hearing from this client she`s confirmed that we`re doing it right !
The market todays dictates that you have to spend money albiet "Flyers, magazines, post cards, Open Houses, Virtual Tours, to get a home noticed, without doing any or all of the above mentioned will no longer get a home sold fast on the market.

Sellers appreciate the little things, when an agent accepts their listing.
I always send out copies of magazines that we advertise from in for the Sellers to view their homes.
Each month we send them a copy. It helps them understand how we`re marketing their home.
In many cases i also send them updates from Realtor.com or our web site on how many "Unique Visitors" they receive each week . Many times, I get a listing that was listed by another agent from another company. They take the listing,never to contact the seller again.The Sellers like input. Updates or feedback on how well their property is doing, gives them a deeper understanding how well their home is priced versus the competition. It`s the little things I believe that will keep a seller happy in a slow market, that makes you stand out from the rest.

Most weekends he takes the jet boat for a spin down the Intracoastal and when he comes home from work there's usually a hot meal on the table and clean clothes in his drawer.Not a bad life for a 25-year-old starting out in the roofing business.
Of course, his parents own the home and the boat. His mom still does the cooking and laundry for him and his sister, Jackie, a 24-year-old teacher, who also shacks up with mom and dad.The Clarks are two of thousands who fled the nest for college, only to return home after graduation when plagued by student loans, dicey job prospects and harsh real estate markets. Experts call them "boomerang kids'' and estimate that between 48 and 66 percent of 2006 college grads are planning to shoot back home this year.But new studies show, boomerang kids aren't just moving back home in higher numbers -- they're staying there for a couple of years. Among last year's graduates, four in 10 are still living with their parents, according to a recent study by MonsterTRAK, which provides online job recruiting services for college students."It's free, the cooking is a lot better and you get to live in a lot nicer place than I normally would with my salary,'' said Clark, who moved to his parents' South Florida home one year after graduating with a business and economics major from Westmont College in Santa Barbara, Calif."And I can save up for a place of my own versus paying rent.''In the past, moving home was a stigma for kids and parents, said David Morrison, president of Twentysomething Inc., a young adult consulting agency in Philadelphia that randomly surveys 2,500 college seniors by phone every year."Parents felt they failed their children somehow. Now, it's a widely accepted mainstream option for college grads, a very pragmatic response to the economy around us,'' said Morrison.The average graduate has $2,200 in credit card debt. Close to two-thirds of college kids have student loans, with an average debt of $17,600, according to the Center for Economic and Policy Research."These students are burdened with debt both from a student loan perspective and credit card perspective and starting salaries haven't escalated from a wage perspective. WEST LAKE WORTH -- After months of headaches, nausea and occasional seizures, Andrea Amaral abandoned her custom-built dream home, blaming the mold that grew in it for her medical problems.The tastefully designed home in the Savannah Estates neighborhood on U.S. 441 had no catastrophic water damage. No flooding, no hurricane damage.
But about a year after moving in, the family discovered mold growing on some air conditioning vents, a smoke detector in Amaral's bedroom, ducts and in the attic.Now the Amarals are battling the builder, Town & Country Homes Florida, a K. Hovnanian Co., in an attempt to break free of the home."The builder knows there is this mold in my house, he knows there are these toxins, he knows that the mold in the house matches the mold in my blood, but he won't do a damn thing," said Amaral, 47. "All I want him to do is buy my house. Let me and my family move on so I can get a clean house."The Amarals first alerted the builder to their mold problem in January, meeting personally with officials and sending e-mails requesting help.Tim Kelly, president of the local Town & County division in Boynton Beach, said the company is investigating."Research is still being conducted by a third-party consultant who is an expert in that field," Kelly said. "Just because a claim is made doesn't mean it's substantiated or it's a builder responsibility."According to the Amarals, Town & Country previously offered to clean the house, but declined to pay the roughly $20,000 the Amarals spent on lodging, environmental testing and living expenses."I don't know how it would be possible to make this house livable for my wife," Steve Amaral said.Andrea Amaral and her family lived in a Hampton Inn for nine weeks until she left for the Bahamas for several weeks this summer for some doctor-recommended ocean air.She and her daughters are now staying at her mother's, while Steve Amaral, unaffected by the mold, stayed home.The Amarals moved into the $416,000 home in June 2004.Less than eight months later, Amaral began to get sick.She also experienced seizures, long after a prior seizure problem she experienced after a 2002 car crash had been stabilized.Steve Amaral is confident the house was improperly insulated, leading to the mold build-up, while Town & Country officials say the culprit is likely the air conditioning unit, he said."It appears the Amarals have a significant problem in their home," said the Amaral's attorney Stephen Cohen."Testing shows that, and Ms. Amaral has certainly proven to be ill as a result of the exposure."One of Andrea Amaral's doctors said Amaral's mold allergy testing is so high, it suggests she is suffering from what doctors term "non-specific building related illness."Symptoms can be as minor as a runny nose. Sky-high premiums igniting a revolt by consumers
Homeowners in Florida are banding together in an effort to fight rising windstorm insurance premiums that threaten to drive some from their homes.

Under fluorescent lights and through a microphone that kept shorting out, Joe Fontana cleared his throat and addressed his small audience.
''The insurance companies are going berserk,'' he said. ``There's no limit to what they will charge homeowners. We have to find a way to counteract this or the people in this city are going to be killed.''
Then Fontana led the 38-building-strong Miami Beach Condominium and Homeowners Alliance in devising a plan to try to stop the runaway cost of windstorm insurance.
Consumers like Fontana, fed up with double- and triple-digit insurance rate increases, are beginning to band together. Decades-old home and condo associations, newly formed grass-roots organizations and accidental neighborhood juntas are cropping up around the state to press for solutions to Florida's escalating insurance crisis.
From the Keys to the Panhandle, the groups are raising money, firing off e-mails, holding meetings, sponsoring petition drives and hiring lobbyists and lawyers to make their case in Tallahassee. Many are starting to see a benefit of wielding a collective fist.
At its meeting Thursday night at the Mimosa condominiums on Collins Avenue, the Miami Beach Alliance explored the idea of self-insuring. But instead it decided to use its political clout.
Noting that it is election season, the group will urge its members, representing about 8,000 home and condo owners, to write and call their elected officials about easing the windstorm burden.
Other groups have embarked on more ambitious endeavors.
STANDING FIRM
Born from a backyard get-together in Key West, a consumer activist group known as FIRM -- Fair Insurance Rates in Monroe -- has raised as much as $50,000 in its effort to fight Citizens Property Insurance premiums in the Keys, inspired by one woman's crusade to have her own insurance rates reduced.
Cindy Derocher was outraged when her property insurance bill rose from $5,000 to $12,000. Instead of paying right away, she applied for mitigation credits and whittled it to $9,600.
''That's what started us doing research,'' Teri Johnston, FIRM's president, said. ``We found out that Citizens was charging us $20.91 per $1,000 of principal coverage. That's in comparison to coastal areas on the Panhandle that were paying $4 per $1,000.''
FIRM, founded in February, boasts 4,000 members. The group chartered an airplane to ferry members to the state's Capitol to meet with lawmakers and invited state Insurance Commissioner Kevin McCarty and U.S. Rep. Ileana Ros-Lehtinen, R-Miami, to Key West.
SMALL VICTORY
Its efforts have paid off -- at least temporarily. In May, McCarty issued an order freezing rates in Monroe County for Citizens, the state-run insurance pool that by law must charge the highest rates in the state.
''When we first started this organization, many people said to us that you can't fight government and you can't fight big business and you can't fight the insurance lobby. We have proved that is not true,'' Johnston said. ``When you get a group of concerned, educated citizens together, you can.''
Many around the state are taking that message to heart.
The 5-month-old Homeowners Against Citizens Florida, a nonprofit out of Pasco County, has seen its ranks swell to 7,000 members statewide. The group says it has collected twice as many signatures on a petition calling for a special legislative session to address the crisis.
Similarly, the year-old two-million-strong Coalition of Community Association of Florida, an umbrella group of homeowners associations, is drafting insurance legislation that it says would make it harder for insurers to randomly drop policies and plans to lobby for it next session.
Make no mistake, motivating homeowners hasn't been easy, said Jan Bergemann, president of Cyber Citizens for Justice, a statewide organization that does most of its activism through the Internet.
''Americans are not very easy to rally together. They would rather watch American Idol than look after their insurance premiums, but it's an emergency and people are coming out,'' Bergemann said.

The switch from citrus to subdivisions could gain steam in western Palm Beach County as G.L. Homes gears up to develop the 5,000-acre Indian Trail Groves.In the first step toward changing guidelines to allow thousands of new homes, G.L. Homes has scheduled a meeting next month with regional planning officials.
G.L. Homes previously proposed building 4,000 homes on the rural property, but recent county projections have the number potentially ballooning to more than 12,000.The builder had once agreed to follow a county development plan for western agricultural land, but state regulators last year rejected that plan.Also, county commissioners might have opened the door to more western development by giving initial approval in May to 10,000 homes on Callery-Judge Grove, 4,000 acres east of Indian Trail Groves.The Callery-Judge Grove proposal calls for about three times as many homes as the county's development plan allows.County officials are negotiating with state regulators to try to salvage their plan, but G.L. Homes cannot afford to wait any longer, company Vice President Larry Portnoy said Wednesday.With the county's plan at a "stalemate," he said G.L. Homes will not commit to limiting the development to 4,000 homes on the property west of the Acreage and south of the J.W. Corbett Wildlife Management Area."We own a very, very expensive piece of property and we are going nowhere very slowly," Portnoy said.Western residents have argued their roads cannot handle traffic that would come from replacing citrus groves with thousands of homes.They also object to cookie-cutter subdivisions moving into an area where most homes sit on an acre or more and horseback riders share the roads with commuters."Callery-Judge just opened the door for everyone else," Loxahatchee resident Nancy Gribble said. "I guarantee [G.L. Homes] is going to come back with some mammoth number of homes."G.L. Homes will not disclose the number of homes proposed until company representatives meet with the Treasure Coast Regional Planning Council on Aug. 21, Portnoy said.He said the proposal calls for a mix of houses and "multi-family" homes, which can include townhouses, condominiums and apartments. Shops, restaurants and other commercial development also are expected."We are really still fine-tuning things now," Portnoy said. "It will be a wide variety."G.L. Homes has suggested building a new road, called Western Way, to accommodate traffic to and from the development. The road would stretch north of Southern Boulevard along the L-8 canal to neighborhoods planned on Indian Trail Groves.Once G.L. Homes submits its proposal, it faces reviews by state and local regulators before it goes before the County Commission.A county plan a decade in the making was supposed to guide development of Indian Trail Groves and land between Wellington and Palm Beach Gardens. The "Sector Plan" called for 27,500 homes -- 8,000 more than once envisioned -- on 53,000 acres west of West Palm Beach.State regulators rejected the plan because of concerns that it did not do enough to address development's potential strain on roads and the environment. The county has yet to approve a new version."Hopefully we can come up with a settlement faster than [Indian Trail Groves] can submit something," said Barbara Alterman, executive director of planning, zoning and building.

The median sales price of an existing home in Lee County fell 5 percent in June, the first year-over-year decline countywide in seven years.A home sold with the help of a Realtor had a median price of $268,000, down from $281,000 in June 2005, according to data released Tuesday by the Florida Association of Realtors.The decline, coupled with a drop in building permits for new construction of 26 percent over June 2005, is further evidence of the slowing housing market. Earlier this month, Bonita Springs-based WCI Communities Inc. confirmed it would lay off workers because of the declining market.“The market is changing a lot from what it was just a few months ago,” said Pedro Diaz, a real estate agent with Century 21 Birchwood Realty. “It’s a better time to be looking to buy a house because there are more houses up for sale and they are being listed longer.”Home sales slowed 31 percent in Lee with a total of 891, down from 1,297 in June 2005.
Condominium sales plunged 66 percent to 150 sales in Lee, with an average sales price of $250,000, down 7 percent.Statewide, existing home sales decreased 29 percent, although home prices climbed 3 percent, to $257,800. Nationally, existing home sales dropped 1.3 percent in June to a seasonally adjusted annual rate of 6.62 million units. The median price was $231,000, up 0.9 percent from June 2005, the smallest year-over-year price gain since May 1995. The big worry is that declining sales could send shockwaves through the economy, much as the bursting of the stock market bubble in 2000 contributed to the 2001 recession.Economists expect the decline in the economy to contribute to a slowdown in growth but not to an outright recession.The last countywide decline in Lee was recorded in June 1999 when the median price fell 1 percent to $105,200. Declines were noted in December 2000 and April 2002, but those months lacked data from Bonita Springs and Cape Coral, respectively.“That was a little surprising, but I’ve noticed a little weakening in the past few weeks,” said real estate agent Brett Ellis, of RE/MAX Realty Group.However, Ellis said sales numbers may once again begin to climb as sellers lower their prices to attract buyers.“They are getting down to where the buyers are, so I wouldn’t be surprised to see those numbers level out or pick up in next few months,” said Ellis, noting that interest rate increases have slowed. “Buyer power has increased for consumers, and we haven’t seen that for a few years.”Former Lee County resident Joanne Sassaman, 66, just closed on the sale of her Colonial Country Club home this week. She listed the home for sale in January, and it has been under contract since April.“Every other home I’ve sold has sold in seven to 10 days, so this was a little frightening,” Sassaman said from her new home in Bethlehem, Pa. “We ended up knocking about $100,000 off of the original listing price.”The home sold for about $325,000, more than 50 percent higher than she paid two years ago.“I was happy with that,” she said. Dagoberto Giron, 32, of east Fort Myers, finds himself on both sides of the market. He hopes to sell his home on Luckett Road and move to a larger home elsewhere.“Everything is kind of low compared to what prices had been,” Giron said. “I think I will be able to sell my home and get a better deal.”Giron just began shopping Tuesday, but he liked what he had seen so far.“If I see what I like, I’m ready to sign a contract right now,” he said.Nationally, analysts said the growing level of unsold homes will further depress prices in coming months and add to the slowdown in sales.“With interest rates still rising and job growth slowing, the slowdown in sales will continue,” predicted Patrick Newport, an economist at Global Insight, an economic consulting firm.He expects existing home sales to decline by 8 percent this year and 9 percent in 2007.David Lereah, chief economist for the National Association of Realtors, said he thinks the decline in housing sales is beginning to level out.Sales of new and existing homes set records for five consecutive years, but rising mortgage rates that have risen to the highest levels in four years have dampened the sales boom this year. First, Hurricane Wilma ripped off their roofs, then crooks plundered their refrigerators, kitchen faucets and anything else they could cart away.Thieves in May stole the Frigidaire stove from Richard Wachs' condominium at Sunrise Lakes Phase III, under repair since the Oct. 24 hurricane clobbered South Florida.

"Unfortunately the [construction] workers, when they leave the apartments, they don't lock the doors or shut the windows," Wachs, 85, said in a telephone interview from his temporary apartment in Plantation. "They made no effort to protect the items that were in there."Wachs is among a growing number of hurricane victims who evacuated their homes only to have their belongings pilfered. In the sprawling Sunrise Lakes complex, an ungated seniors-only community, 52 thefts were reported between January and May, up from 33 in those five months last year.Although police don't specifically track hurricane-related crime, several agencies report either an increase since Wilma or blame the storm for a growing proportion of thefts. Despite stepped up patrols in some areas, it is not clear who is responsible.With winds of more than 100 mph, Hurricane Wilma and the string of weaker storms that followed booted hundreds of Sunrise Lakes residents from their homes. Many of the displaced still languish in temporary apartments, paying both rent and condo maintenance fees as repairs stretch into the ninth month."Immediately after the hurricane, crime analyses showed there was an increase in crime in the area," said Sunrise police spokesman Lt. Robert Voss.Fort Lauderdale police say Wilma accounts for a growing proportion of thefts in their city, though the numbers are steady at about 400 for the first five months of both 2005 and 2006."We've had some unfortunate cases where opportunists will take advantage of a broken window that hadn't been repaired or a door that maybe was not as secure prior to Hurricane Wilma," Fort Lauderdale Detective Katherine Collins said.In Margate, the number of theft reports jumped 19 percent, to 100, for January through May this year, up from 81 in 2005, police Detective Chip Kolenda said. In Deerfield Beach, Oakland Park, Tamarac, Weston and other cities patrolled by the Broward Sheriff's Office, residential theft rose 3.2 percent, to 1,113, for the first five months of the year, up from 1,077 the previous year.In Tamarac, Myles Sockin returned to his Southgate Gardens condo in April to find his furniture in pieces and his JVC stereo and two 13-inch televisions stolen. Roofers are repairing seven Southgate buildings comprising 108 condominiums that were evacuated after Wilma."I opened my door, and my apartment looked like Hiroshima," said Sockin, 51, who has stayed with friends since his ceiling collapsed. "We've been victimized by the hurricane, and here we are being victimized by burglars again."Terence McElroy, a spokesman for the state's Department of Agriculture and Consumer Services, said victims of theft might file claims with their insurance companies, report them to the police or sue the companies responsible for the homes' security.Timothy Woods, a vice president at Woods Restoration Services LLC, the Newington, Conn.-based company in charge of replacing water-damaged roofs and walls at Sunrise Lakes Phase III, said his construction supervisors sign an agreement making them personally responsible for locking apartments at the end of each day. No workers have been fired for leaving doors unlocked, he said. And none has been arrested on suspicion of theft."Could people be going there and finding a door open?'' Woods asked. "It's possible, but we are trying to limit access to only the people that need to be in there."Not so, said Richard Fleming, 64, who lost the kitchen faucet from his condemned Phase III apartment."They leave the doors open so workers can come and go," said Fleming, a metal finisher who, with his wife, Gloria, has lived in a rented apartment in Sunrise since November. "People come in and work on the building and see something they want and take it."Sunrise Lakes Phase III was hard hit by Wilma, with 31 of 93 buildings at least partly condemned.Given the comparatively greater extent of repairs needed at Phase III, Woods said, his company hired a private security firm to patrol the property with two undercover guards."It is a wide site, it is very expansive, which is making it a little difficult," Woods added. "But we think we are doing a pretty good job."Sunrise police responded to last November's increase in crime by intermittently assigning two to four extra officers to aid the lone officer who patrols Sunrise Lakes, Voss said. They also "conducted numerous sweeps out there to verify that the workers there belonged there," he said.Arrest figures for thefts were not immediately available, and Voss declined to comment on possible suspects because he said it would jeopardize ongoing investigations.

The massive collapse of the hurricane insurance market for Florida businesses has morphed from an economic headache just weeks ago into a clear and growing threat to the region's economic vitality, experts say.
Among the troubling signs:
• Some sales of commercial property are grinding to a halt.
• Business borrowers are bordering on default with their bankers.
• Companies are developing plans to create their new jobs elsewhere or move out altogether rather than pay the high cost of operating here.
Ultimately, business leaders say, the lack of affordable windstorm insurance could do something no hurricane ever has done to South Florida: produce permanent, crippling economic damage.
''It is a crisis situation,'' said Frank Nero, head of the Beacon Council, Miami-Dade's tax-funded economic development agency. ``This is not just a case of companies making less money. It's not being able to stay here, or expand here, or move here. And that ultimately translates to fewer job opportunities.''
It isn't just a headache for business owners -- much of their higher costs are likely to ripple into consumers' pockets.
For instance, Michael Lefkowitz, who owns three Dunkin' Donuts shops in South Florida, had to raise prices when electricity costs soared earlier this year. Now his insurance is going up 60 percent, leaving him with two unappetizing prospects: raise prices again and risk alienating customers or absorb expenses that weren't built into his budget.
''I'll have to see what the market will bear,'' Lefkowitz said of price hikes. ``I may turn away customers who don't want to pay 15 to 20 percent more for a cup of coffee or a doughnut.''
Lefkowitz says the pain is going to get worse, because his landlords are also passing along higher insurance costs.
That represents the next phase of the situation, said William Holly, president of Holly Real Estate in Miami. The increases hitting building owners ''won't be felt by tenants until next year because pass-throughs are typically calculated at the beginning of the new year,'' Holly said.
Unlike homeowners, who can turn to the state-run Citizens Property Insurance, businesses have no Tallahassee-backed windstorm insurer.
Alarmed civic leaders are banding together to beseech Tallahassee and even Washington for relief. The Broward Alliance, for example, is polling its members on their specific problems in order to form a battle plan.
''Is it access? Is it cost?'' said Jim Tarlton, the Broward Alliance executive director.
Actually, at the moment it's both -- and more. Some insurers are leaving the state, others are hoisting premiums and some are pushing deductibles to levels that could themselves prove devastating if a business gets damaged.
And many business owners worry time is short, the efforts are fledgling -- as the most active period of the hurricane season looms.
Secure Wrap founder Radames Villalon is an example. The Miami firm, which provides baggage-wrapping services at airports, saw windstorm deductibles rise from $61,000 last year to a whopping $1.5 million this year.
''I already told them, I'm not going to take this policy,'' Villalon said.
LENDERS' DEMAND
But that, in turn, could put him into hot water with his bank, which requires adequate insurance on his mortgage and line of credit.
''I called the bank and told them they have to do something,'' Villalon said. But he is growing weary of dealing with it, and notes there's no compelling reason why he must remain in an increasingly costly South Florida.
''I can do my business from anywhere,'' he said.
So can Ted Platon, owner of EuroKitchen in West Miami-Dade. His insurance rose five-fold, but his bank threatened to close his line of credit if he didn't buy it.
Because his prices are locked in by long-term contracts -- EuroKitchen outfits the kitchens in luxury high-rise condos nationally -- he can't pass on the higher costs.
So he will expand staff at existing operations in Las Vegas, New York and Washington, D.C. ''Those are jobs I won't be adding in South Florida,'' Platon said.
Others say commercial real estate -- one of the key components of the South Florida economy -- is being undercut by a lack of insurance.
Recently, Ernesto Casal, a principal in Miami's Capital Commercial Group, had a $6 million warehouse deal fall through over insurance. The buyers' windstorm premiums had been expected to be about $50,000. They came in between $150,000 and $200,000.
''Insurance has always been a last-minute thing that came at the end of the equation,'' Casal said. ``It wasn't something that we truly worried about.''
To be sure, businesses had their windstorm problems going into this season.
For example, the DeSoto Ocean View Inn in Hollywood suffered $70,000 in damage last year. There was a $10,000 deductible, and the insurer paid only $27,000. So the hotel was in the hole for $43,000 altogether.
''Our rates go up, but is our coverage really better?'' asked Steve Welsch, the manager.
Earlier this year, ''insurance costs skyrocketed beyond logic,'' said Alan Ojeda, a developer preparing to start construction on what would be the biggest Miami office tower in two decades.
For some builders, it means assuming more risk themselves.
Related Group, the biggest condo developer in the country, took out just $75 million in coverage on its new ICON Brickell complex, a billion-dollar project, reasoning that it will only come out of the ground by the time hurricane season ends. Lender HSBC agreed.
But next year the developer plans to seek full coverage. It hopes insurers have returned to the market. ''We can't afford a busy hurricane season,'' said Matt Allen, Related's chief financial officer.
A GLIMPSE OF HOPE
Developers and builders got a small break Friday when Citizens, the state-run insurance pool, decided to continue writing builders' risk insurance, which covers ongoing construction projects. The potential lack of coverage had caused panic among some builders and developers.
Meanwhile, some property owners are ''going bare,'' or simply dropping coverage. Bobbi Zoberg, who owns three strip shopping centers, took this approach after the windstorm tab more than quadrupled. Since she owns these properties outright, she doesn't have to accommodate bankers, and her tenants couldn't afford it if she passed the increases along.
''I can't put all my tenants out of business,'' Zoberg said.
BANKS IN THE MIDDLE
Caught in the eye of the hurricane insurance crisis is the banking industry. They require business clients to carry adequate insurance.
But many customers say they can't obtain it. Although banks have the right to buy insurance in the client's name, many banks can't find it either.
''Some of our clients are getting 1,000 percent increases,'' said TotalBank President Bill Heffernan. ``The full impact hasn't been felt yet because a lot of policies don't expire until after hurricane season.''
Institutions are struggling for alternatives. Great Florida Bank, for instance, is assessing whether borrowers can self-insure against some damage, or carry less insurance if they keep a higher escrow on deposit.
It's a time-consuming effort, ''but it's how you build loyalty,'' said Mehdi Ghomeshi, Great Florida's president.
The Florida Bankers Association is heading to Washington next week to lobby Congress for some type of action, possibly a national catastrophe fund. But ''there are no easy answers to this,'' acknowledges Alex Sanchez, chief executive of the industry group.
Locally, the Greater Miami Chamber of Commerce has formed a windstorm task force it hopes will become a statewide movement.
''We are looking at what we can do with other chambers in Florida, and look at other states,'' said Barry Johnson, the chamber's president. ``It's clearly an issue whose time has come.''
Business owners as well as insurance brokers, real estate professionals and bankers are frustrated about the lack of near-term solutions from regulators and legislators.
''The insurance department has dropped the ball on this crisis. By the time they finish talking, we could have been hit by a hurricane,'' says Carlos Allen, vice president of Pan American Assurance, a Miami insurance agency.
Kristy Campbell, spokeswoman for Gov. Jeb Bush's office, said Wednesday that ''the governor has no plans to call a special session regarding insurance.'' Bush created the Property and Casualty Reform Committee in June, Campbell said, to improve competition and create incentives for insurers to remain in the market. The committee's first report is due Nov. 15.
Can Florida wait that long? Ricky Arriola, president of Inktel Direct, is concerned. Arriola heads the Miami chamber's insurance task force.
''At some point, does it become cost prohibitive to stay in Florida?'' he asked rhetorically. ``Then you have employers leaving. You could have real problems.''
